Employment Partner Susan Thompson comments on best practices for conducting a redundancy process and issues surrounding 'managing out' employees, in People Management.

"The legal definition of redundancy is quite precise. It tends to mean an organisation needs fewer employees to do the work that is available, or that a workplace has to close.”

“Doing [performance-related exits] properly takes a long time. You have to give an employee a warning, an opportunity to improve, and put in tools to help them in areas where they are weak. It doesn’t take much for a tribunal to see through it if you dress it up as something else."

“There may be people champing at the bit if you offer voluntary redundancy.”
